To the official of Brechin. Mandate to rehear and examine a claim
to the patronage of the church of Kyrkmaho, Glasgow diocese,
brought by the abbot and convent of Arbroath against the late Sir
John Stewart de Kamsala. The abbot and convent claimed that the
case had been brought originally before the official of Glasgow
without apostolic delegation, and that he had pronounced a definitive
sentence in favour of Sir John and his successors who had con¬
sequently for the last thirty years presented clerks to the ordinary
of the diocese for institution by him in this church when it was
vacant. The abbot and convent represented that through the negli¬
gence of the abbot and convent of that time, an appeal had not been
made to the papacy and they were now remedying that default. The
pope therefore granted the above mandate for witnesses to be called
to settle the case.

To the bishop of Brechin. Mandate to restore after due examination
of the case, to Walter, the abbot and the convent of Arbroath, osb,
the vill of Tulogh, Brechin diocese, which had been handed over
with all its rights and pertinents by the late John, abbot of the said
monastery, to the late Walter de Tulogh, doncel, and his heirs, in
return for an annual payment in kind, as no one within the kingdom
of Scotland was called as witness and the monks there present con¬
sented for fear of John.
