2 November, 1411 Reg Aven 339, 549-549V
To the bishop of Glasgow. Mandate to dispense the nobleman
Thomas Somervyl, doncel, to marry anew the noblewoman Eliza¬
beth de Gordon, Glasgow diocese. Thomas and Elizabeth in full
awareness of being related in the third and fourth degrees of con¬
sanguinity had nonetheless contracted marriage per verba legitime de
presenti and had lived together; but fearing that if a divorce should
arise Elizabeth would be perpetually defamed, they sought a dis¬
pensation and absolution from the sentence of excommunication in¬
curred by them. The dispensation is granted as above and absolution
is to be granted by the mandatory after Thomas and Elizabeth have
separated for a time fixed by the mandatory; any child born is to
be legitimate, and Thomas and Elizabeth are held to pay a certain
sum of money, at the discretion of the said mandatory, to a holy
place or to the poor of Christ.

late abbot Patrick. The pope wishing to provide the said Patrick
to the monastery then vacant, had reserved the provision to himself
and Patrick had been provided; but on his death the convent of
the monastery, perhaps in ignorance of this decree, had elected
William as abbot and he consented to the election which was con¬
firmed by Henry, bishop of St Andrews. William, then hearing of
the reservation had appealed to the pope who annulled his election
and any subsequent proceedings, but not wishing to harm the
