of Balmerinodi that if this were true Richard was to be collated
to the hospital and Henry surrogated to the rights claimed by the
said Roger, and Henry was to adopt the regular habit of the star of
Bethlehem. Disputes had then arisen between Richard, Roger and
Henry, and John, abbot of Balmerinoch, by virtue of the papal
letters, delegated Richard’s part to be heard before Thomas de
Karnis, rector of Seton, said diocese, official of St Andrews, and in
the dispute between Roger and Henry, he had delegated Henry’s
part to be heard before Alexander de Lillisclefe, archdeacon of
Dunkeld. Henry, however, feeling himself aggrieved by the said
Thomas, had appealed to the apostolic see, and then called the said
Richard before Patrick de Houston, canon of Glasgow, who had
been deputed to hear the case by apostolic authority following the
appeal to the apostolic see. The aforesaid official, however, not
deferring to the appeal, proceeded with the case and promulgated
a definitive sentence on Richard’s behalf against Henry and Roger,
from which sentence Henry had again appealed to the apostolic see,
and at the instance of Richard the case was committed for settlement
to the above mandatory. Henry’s petition had continued that some
people asserted that neither he or Richard had any rights to the said
hospital which is, therefore, said to be vacant, so by the mandate, if
this is found to be true, then the said Henry de Ramsay, of noble
birth, os A, is to be collated to the said hospital which has cure,
and is worth -£54 sterling to a non-resident, after he has adopted
the regular habit as above.1
