JUSTICE OF PEACE COURTS.
Sittings of the Small Debt Court, everj' Tuesday
and Friday at 11 o'clock in the Justices' Hall,
County Buildings, 117 Brunswick Street. Sittings
for summarj' proceedings and criminal cases in the
Justices' Hall, on Monday and Thursday at eleven
o'clock. Business is transacted in the Clerk's Office,
County Buildings, 111 Brunswick Street, Glasgow,
every day from 9 a.m. till 5 p.m., S.aturdaj' excepted,
when the office shuts at 2 p.m. George Crawfurd,
clerk of the peace; George Gra}' and Jas. Christie,
deputy-clerks ; Robert Duncan Douglas, procurator-
fiscal ; James Walker, bar-officer.
SMALL DEBT COURT OF THE JUSTICES.
This Court, on six days' induciiB, decides claims
of £5 and under, sits every Tuesday and FriJaj-, at
11 o'clock forenoon, in the Small Debt Court, Jus-
tices' Hall, County Buildings, 117 Brunswick Street.
Two Justices are the Judges. Summonses and war-
rants are issued for the Lower Ward of Lanarkshire
at the Justice of Peace Clerk's Office, County Build-
ings, entering by 111 Brunswick Street. George
Crawfurd, clerk of the peace ; George Gray and Jas.
Christie, depute-clerks.
SHERIFF SMALL DEBT COURTS,
For the recovery of debts not exceeding £12, sits
every Monday, "Wednesdaj', and Thursdaj', for Glas-
gow, on Tuesdays for Lanark and Airdrie, and Fri-
days for Hamilton, and have jurisdiction over the
whole of Lanarkshire. The defenders are cited be-
fore this court on an induciiB of six daj-s : warrants
to arrest on the dependence are issued ; the decree
may be extracted, and arrestments used upon it
instantl}' ; and it may be enforced, in all cases, by
poinding and sale of the debtor's effects, and when
above £8 Gs. 8d. by imprisonment, all ten free days
after its date. In case of the debtor removing to a
different county, the decree may be enforced against
him tiiere, on being endorsed by the Sheriff Clerk of
the county to which he removes. Judges — Sheriff
and Sheriff-Substitutes of the county.
jVote — An act was passed in 1840, abolishing
imprisonment for debts under £8 6s. 8d., excepting
claims of aliment.
FORM OF PROCEEDING IN THE RECOVERY
OF SMALL DEBTS.
Debts may be recovered in a summary manner be-
fore the Justice of Peace Court to the extent of £5 ;
and before the Sheriff Courts to the extent of £12.
The first step is set forth in a complaint or libel,
agreeably to a prescribed form (the Clerks of Court
will provide the necessary forms), the origin of the
debt, or ground of action ; and to cause the same,
with a copy of the account, if any, to be served ou
the defender.
A warrant will, at the same time, be obtained to
cite witnesses.
The parties may appear either by themselves or
y members of their families, or others whom the
curt may authorise ; but in no case by persons
practising the profession of the law, or by officers of
Court, w^ithout special leave of the Court, on cause
shown.
If the defender fail to appear after being cited, he
will be held as confessed, and judgment will be given
against him.
But when decree is given in absence against the
defender, he may, before the expiry of the charge,
apply for a rehearing, on consigning the sums de-
cerned for in cases before Justices, and in cases before
Sheriff by consigning 10s. of expenses, on applying
within three months from date of charge.
If decree in absence be given against the pursuer,
he may, within one month, obtain a rehearing on con-
signing 2s. 6d., if the case be before the Justices ;
and the expenses decerned for, with 5s. to meet fur-
ther expenses, if the case be before the Sheriff.
The case will be adjourned upon the pursuer or
defender oft'ering a suitable excuse, or if any witness
be absent.
If decree be given against the defender, diligence
may proceed against him hy arrestment instantly ;
and by poinding and sale, and, if above £8 6s. 8d.,
by imprisonment, all at the end of ten days before
the Sheriff; and by poinding and sale instantly, be-
fore the Justices.
If decree be given against the defender in his ab-
sence, poinding and sale, or imprisonment, as above,
can only follow after a charge of ten days.
The defender, on showing cause, may be allowed
to pay the sums decerned for by instalments.
The decrees of the Sberift' and of the Justices may
be executed in any county, on the same being en-
dorsed by the clerk of such county.
Any arrestment used in cases before the Sheriff
must be used within sixty days after the warrant is
obtained, and renewed every three months ; and such
arrestments may be loosed, on offering sufficient
caution, or on showing evidence of absolvitor or pay-
ment, or on consigning the sums demanded, if be-
fore decree.
The above forms will apply to any action of forth-
coming whatever, before the Sheriff, for making
effectual arrestments ; but in such actions both the
defender and arrestee must be cited to appear in court
on the same day.
Decrees, pronounced in this summary form by the
Sheriff, will only be reviewable by the next Circuit
Court of Justiciary ; or if there be no Circuit Court,
by the High Court of Justiciary at Edinburgh, on
the ground of corruption, or malice, or oppression,
on the part of the judge.
Such decrees, when pronounced hy the justices,
will onlv be reviewable by a reduction before the
Court of Session, on the ground of malice and oppres-
sion on the part of the justices, and such reduction
will only be competent for one year, and finding
caution for costs.
No person is exempt from the jurisdiction of jus-
tices or sheriffs in such cases, by reason of privilege
as a member of the College of Justice.

Held every lawful day, at 10 o'clock, in the Police
Office, South Albion Street, Glasgow ; and in the
Police Offices of Gorbals, Anderston, Calton, and
Cowcaddens respectively.
