342 LETTERS OF POPE BENEDICT XIII

To the precentor of Segorbe, James de Haldenston, canon of St
Andrews, and John de Kyrkmychel, canon of Glasgow. Mandate
to collate David de Hamilton, perpetual chaplain of the chapel of
St Thomas the Martyr, Glasgow diocese, in deacons orders, to the
parish church of Cumnock, Glasgow diocese, value not exceeding
^30 old sterling to a non-resident. On the death outside the curia
of George de Dunbar, late rector, David had been presented to the
church by the lay patron Sir Patrick de Dunbar, and having obtained
possession he had held it receiving its revenues for more than four
years without being raised to priests orders and without a papal
dispensation. Subsequently although having all stain and inhability
contracted by this abolished, he was held to demit the church; but
to prevent a long harmful vacancy this mandate is provided.1

the parish church of Cuminok, Glasgow diocese, by Sir Patrick de
Dunbar, lay patron and who had possessed it, receiving its fruits,
for more than four years without being raised to the priesthood and
without a papal dispensation, to have abolished all stain and inhability
contracted by this; but he is held to demit the church.2

familiar and chaplain. Indult for James to reside at the curia and
receive the fruits and profits of his canonical portion in the church of
St Andrews without being bound by the constitution requiring daily
residence, and notwithstanding the constitutions of Boniface vm or
any others to the contrary.
