Comperit the liaill perfonis of Allyle, and declairit that thai haif onwaittit this
tua dayis vpone thair call, and ar fnperexpendit ; and proteftit that thai be nocht
vnlawit heirefter, in cais of thair uon-compeirance.— Continued to 17th, and
afterwards to 18th.

Rolment of Court, producet be the pannell, I'ubfcryuit be Mr Johne Fouller-
toun, and pi'oteftis (that) the famyn remane in proces ; and adheris to the
alledgeances, that he is ifylit of the crynie, be his awin Confeffioune, be ane AlTyfe
alreddie ; and defyres only that dome may be pronuncet aganis him, conforme
to the laM'is ; and that in relpect of the Rolment producet ; and confentis lie
pafs to na Affyfe. — It is anfuerit be the pannell, that na dome aucht of new to
be gevin, becaus thair is a judgement alreddie gevin be the Judge, conforme to
the Rolment of Court ; and that in refpect of the Act of Parliament, quhair it
is in'ovydit, that a man anis being clanget, can nocht be of new perfewit for

enterit on pannell, as he that was convict be ane AlTyfe, in ane Juftice- Court
halding in Stanehy ve, the xv day of September, the yeir of God I™, fex hundreth
and tua yeiris, be Johne Keyth in Coltovm, Slieref-deput of the fcherefdome of
Kincardin, and Capitan Andro Stewart Jiulge, be vertew of our fouerane lordis
CommifRoune, direct to my Lord SherefT of Kincardin, for cuming to George
Sincleris houfe, &c. ; cjuhairvjione na dome wes pronuncet : For the qidiilk
caufe the Jullice-depute decernit and ordanit the faid Andro Reid to pafs furth
of this realme, betuix the day and dait heirof, and the tent day of Auguft nixto-
cum ; and never to returne within the famyn ; hot to remane Baneifchit diu-ing
all the dayis of his Ij'fe, vnder the pane of deid : And all his moveabill guidis
to be efcheit and inbrocht to our fouerane lordis vfe, as convict of the faid
crymes ; qxdiilk was pronuncet for dome.
Compeirit Cajjitaue Andro Stewart, and proteftit, that the fentence and dome
of Baneifclnnent pronuncet aganis the faid Ancb-o Reid in Innerbervie, be na
wayis preiudjciall to the actioune of Errour, to be intentit aganis the Aftyfe,
for Clangeing of the faid Andro Reid of the crymes confeft be him.
