(a) take such special measures, and
(b) by public notice prescribe such temporary regulations to be
observed by the public or by any person or class of persons,
as he shall deem necessary to prevent the outbreak of such disease or the
spread thereof.
(2) The Commissioner shall forthwith report to the Corporation any
measures taken and any regulations prescribed by him under sub-section (1).
327. Under section 461 of the Act the Corporation is empowered to
make bye-laws from time to time, not inconsistent with the Act, with respect
to the following among other matters:-
(a) Regulating, in any particulars not specifically provided for in this
Act, the construction, maintenance and control of drains, ventilating shafts,
or pipes, cesspools, water-closets, privies, latrines, urinals, drainage-works of
every description, whether belonging to the Corporation, or to other persons,
municipal water-works, private communication-pipes and public streets;
(b) Regulating all matters and things connected with the supply and
use of water.
At present there do not appear to be special by-laws relating to the
above matters.
328. Penalties under the Act are prescribed as follows:-
Section 471.-Whoever-
(a) contravenes any provision of any of the sections, sub-sections or
clauses mentioned in the first column of the following table or of any
regulation made thereunder; or
(b) fails to comply with any requisition lawfully made upon him
under any of the said sections, sub-sections or clauses,
shall be punished for each such offence with a fine which may extend to the
amount mentioned in that behalf in the third column of the sail table.
In the table which follows the fine which may be imposed under section
377 amounts to Rs. 50 and that under section 381 to a similar amount.
329. Section 472 lays down that anyone who after having been convicted
of contravening certain sections of the Act or failing to comply with any lawful
requisition may be punished with a fine for each day that he continues to
offend. A daily fine of Rs. 5 may be imposed in respect of default under both
sections 377 and 381.
330. Finally, under section 518 power is given to the Governor in Council,
if upon complaint being made to him and after enquiry it appears that the
provisions of certain sections of the Act have not been or are not being duly
carried out and enforced, to make an order prescribing a period within which
such provision is to be carried out or enforced.
Sections 61 and 434 are included in the list of sections referred to.
Sub-section (3) of section 518 empowers the Governor in Council to
appoint some person to carry out and enforce the provisions of any order made
under sub-section (1) of this section if action has not been taken after due notice.
331. At present a proposal for amending section 381 is under discussion.
The proposed amended section would read as under:-
Section 381. If in the opinion of the Commissioner-
(a) any pool, ditch, tank, pond, well, quarryhole, drain or water-
course, or
(b) any cistern or other receptable for water, whether within or out-
side a building, or
(c) any low-lying or other land on which water accumulates and
which is situate within a distance of 100 yards from any building used as
a dwelling house,
