served, that in the Lowlands the young
and inexperienced Earl Marischal was the
principal sufferer, though there were others
of the same and higher rank equally guilty,
seemingly, because he was of Clan Chat-
tan, or Highland extraction. As to the
Highlands, Keppoch was the principal
victim. The British constitution had been
for some time in a state of melioration, the
legal prerogatives of the crown were de-
fined, and the absurd pretensions of pas-
sive obedience, non-resistance, and arbi-
trary power, were done away by the revolu-
tionary principles of 1688. From this
hopeful state of progress, the nation was
all at once, by this clan act, precipitated
back to the ancient and worst state of feu-
dal anarcy, misrule, and oppression; as
many subjects superior, as many judges
over their vassals and tenants, who, with-
out the benefit of jury, were liable to be
stript of their all; the slightest suspicion,
or the smallest evidence would be sustain-
