This Indenture made this seventh day of
May One thousand eight hundred and twenty eight Between
Washington Irving late of New York in America and now at
Madrid in the Kingdom of Spain Esquire of the one part and John
Murray of Albemarle Street in the County of Middlesex Bookseller and
Publisher of the other part Whereas the said Washington Irving has
written composed and compiled and is now completing a Work or History
entitled or intended to be entitled “A History of the Life and Voyages
of Christopher Columbus” consisting of four volumes octavo And whereas
the said Washington Irving has contracted and agreed with the said John
Murray for the absolute purchase by him of all the copyright life interest
produce profits benefit and advantage of the said Washington Irving
of and in the said Work or History as aforesaid written by him at and for
the price or sum of Three thousand one hundred and fifty pounds sterling
to be paid by the instalments in the manner and at the times following
(that is to say) the sum of Three hundred pounds to be paid in cash
at the time of sealing and delivering these presents, the further sum
of Four hundred and fifty pounds to be paid six months from and
after the first January One thousand eight hundred and twenty eight, the
further sum of Four hundred pounds at nine months after the said first
January One thousand eight hundred and twenty eight, the further sum of
Four hundred pounds at twelve months after the said first January, the
further sum of Four hundred pounds at fifteen months after the said first
day of January, the further sum of Four hundred pounds at eighteen
months after the said first day of January, a further sum of Four
hundred pounds at twenty one months after the said first day of January
and the last sum of Four hundred pounds at twenty onefour months after the
said first January One thousand eight hundred and twenty eight, for which
said several sums making altogether the said sum of Three thousand
one hundred and fifty pounds the said John Murray has agreed to give his
respective seven promissory Notes bearing date the first day of January One
thousand eight hundred and twenty eight and payable accordingly And
whereas it has been also agreed that in case either or any of the said
Promissory Notes should not be paid on the day of the date thereof the
said John Murray his heirs executors administrators and assigns should
on being thereto requested reassign to the said Washington Iriving one eighth
part or share of and in the said copyright in the said Work or History
for each of the said Promissory Notes on which default of payment shall
be made the whole of the said copyright being considered to be divided
into eight equal parts And whereas the said John Murray has duly made and
