spouse, and he granted on 29th October 1G61, to Alexander
Baillie of Hillhouse, son to Richard Baillie, his brother-german,
another heritable bond for 1300 rnerks, and to Jean Baillie,
his sister, for 1000 merks ; so he seems to have been of an
extravagant disposition. This Richard Baillie was tenant in
Hillend, and third son to Alexander Baillie of Bagbie. Major
Claud Baillie sold Un thank in 1666 ; he was succeeded in the
lands of Bagbie by bis son William, against whom a process of
ranking aud sale was brought by Sir William Menzies of Glad-
stainis, male-creditor and donator to William Baillie (tertius), of
Hardington, who had acquired the lands of Bagbie and others
from Major Claud Baillie's son William, and also against sundry
persons, creditors of William Baillie (tertius), of Hardington,
which action having fallen asleep, was wakened and transf**»««l
against Robert Baillie, his only brother and apparent heir, on
15th June 1703 (Mr William Baillie (tertius), of Harding-ton
and his brother Andrew being both then deceased), and again
wakened at the instance of William Baillie of Lamington, and
James Baillie, Writer to the Signet, son of Alexander Baillie
of Hillhouse, for himself, and as representing Sir William
Menzies, on 22d October 1719. The bonds by Major Claud
Baillie in favour of Alexander Baillie, son of William Baillie,
primus, of Hardington, and Marjory Menzies, his wife, and of
Alexander Baillie of Hillhouse, were produced, also a decreet
of apprising at his instance against William Baillie of Bagbie,
dated 27th Nov. 1672. During the dependence of this action,
the creditors applied to the Court for a judicial factor, and
succeeded in having William Bertram, Younger of Nisbet, ap-
pointed ; and decree of ranking and sale of the lands of Bagbie
and Shillowhead, with the Kirklands thereof, within Harding-
ton and Kirklands thereof, the Half- trust lands of Hardington,
Fallside, Smellgills, Hillend, and Bank, was pronounced in
favour of Mr James Baillie, Writer to the Signet, on 18th
July 1721, at the upset price of L.32,067, 14s. 8d. Scots.
This Mr James Baillie, as has been before observed, was son
of Alexander Baillie of Hillhouse, who was son of Richard
Baillie, brother of Major Claud Baillie of Bagbie, and son of
Alexander Baillie of Bagbie and Unthank. He was born in
1660 ; married Miss Ehzabeth Johnston, daughter of David
Johnston, merchant, burgess, and guild-brother, of Edinburgh ;
